CONSTITUTIONAL FRAMEWORK OF FREEDOM OF THE MEDIA IN SERBIA AND HUNGARY

Although in recent decades there has been a growing tendency to gradually shift the substance of human rights protection from the domestic legal order of the country to international law, due to certain shortcomings of international public law stemming from its systemic features, state constitutions continue to play a major role in protecting human rights and fundamental freedoms. Accordingly, the analysis of the constitutional guarantees of human rights should be the main starting point for improving the framework for their enjoyment and practical application, whereby the application of a comparative method is inevitable, through the comparison of normative solutions in states which are on similar level of development. Starting from the role and importance of media freedom in a modern state, the paper compares the frameworks of media freedom in Republic of Serbia and Hungary through an analysis of the constitutional provisions of the two countries in the postcommunist era.
