DECLARATION „WAR AGAINST CRIME” AS A CHALENGEE TO RULE OF LAW AND DEMOCRATIC POLICING

Abstract

This paper analyzes the potential and real consequences from the use of war rhetoric in the context of the current fight against organized crime and terrorism, and unacceptable tendency of militarization of the police with the aim of its more efficient fighting (war) against crime and terrorism, as well as the potential threat of such an approach and logic on basic democratic values and principles, in particular the adequate protection of human rights and freedoms. „War against terrorism“ is, first of all, dramatically intensified the the unclear distinction between the police and the military, between internal and external security, between war and law enforcement. Also, it is now obvious that the war has provided strong justification for increased participation of paramilitary units in the police action. Although this trend could be partly justified, there is a problem that the regular police force, functioning in a social context that overly emphasizes the ideology of militarism, can be incorporated into the traps of paramilitary subculture. In such circumstances, it is quite certain reduction preventive and proactive functions of the police, and his return to the status of reactive and retributive service. In addition, it diverts attention from more effective strategies to combat crime, the publication of "war crime" carries a huge risk of police violence and violations of citizens' rights. A particular problem is thus conceived policies of crime control can easily cause a spiral of violence in society.
